Should a customer use more than the allotted 5,000 minutes per month, it can generally be concluded that they are not using the service for residential purposes—therefore a commercial account would be more suitable. The 5,000 minutes would pertain to any outbound calls (local, long distance and international). Inbound calls are not included. This practice is fairly standard throughout the telecomm industry. FonVantage reserves the right to review usage of unlimited minute usage plans to ensure that there is no customer abuse of such plans. Customer agrees to use unlimited minute plans for normal non-commercial voice calls and will not employ methods or devices to take advantage of unlimited plans by using service excessively or for means not intended by FonVantage, including commercial or business uses. FonVantage may terminate service immediately if, in its sole discretion, customer is abusively using the unlimited minute plan. Without limiting the foregoing, FONVANTAGE RESERVES THE RIGHT TO CHARGE CUSTOMERS $0.039 PER MINUTE FOR ALL USAGE IN EXCESS OF 5,000 MINUTES IN ANY THIRTY CONSECUTIVE DAYS PERIOD (IN ADDITION TO ANY INTERNATIONAL TOLL OR OTHER CHARGES INCURRED IN CONNECTION WITH SUCH USAGE).
